California Department of Education Work Permit Requirement

- It is the position of DLSE that the California Labor Code does not apply to a state or local agency unless the agency is expressly included in the statute. The child labor statutes do not expressly include state or local agencies.
- All governmental agencies are subject to FLSA and shall follow all child labor provisions, including having a Certificate of Age to verify permissible employment (29 CFR Section 212). California issues Certificates of Age using the โStatement of Intent to Employ a Minor and Request for a Work Permit - Certificate of Ageโ (CDE Form B1-1) to provide proof of age (EC Section 49114).
